August 26, 2021 - FBA Comments to SCOTUS Commission

The FBA shared its unique and nonpartisan insight with the Commission on the Supreme Court of the United States pursuant to Executive Order 14023, which instructed the Commission to seek public comments on the debate regarding the role and operation of the Supreme Court in our constitutional system and the functioning of the current judicial nominating process. The FBA encourages the Commission to study the role of the Supreme Court in our legal system in light of the fundamental constitutional principles identified in our statement. Most simply, the FBA encourages the Commission to ask: (1) would a proposed change improve the administration of justice; (2) who has the power to make this change; and (3) how should that power be used?
